I am in need of a programmer to code a game my partner and I are working on. The details of the game will be further explained after a Non-Compete and NDA form is signed. But the game will approximately have maybe 5-10 Levels.
You must already have Unity for the iphone, there will also be a contract with milestones included for each payment. The game will be released for both the iphone and ipod touch.
Pay will be $1,500 if you are indeed interested send us links to your previous works and a year experience in developing games for the iphone would be nice.
But not necessary, as long as you know what you are doing that'll work. Thanks |

Just as a general guideline for dealing with contractors, you should either not have a non-compete at all or the non-compete should be specific to starting a new venture that competes in a very specific way.
A contractor's job is to get as many clients as possible, including those that compete with each other. In fact, if a contractor wants to gain expertise in a field, he/she will especially want to work with clients that compete with each other.
For example, if the contractor wants to specialize in game programming for 3D FPS iPhone games, he/she will want to get as many clients as possible who make those games. Signing a non-compete prevents gaining that expertise.
The contractor can't unlearn knowledge gained by working on projects, and anything that's a trade secret is already covered by general copyright law and the NDA. Stealing ideas doesn't need to be covered by a non-compete.
So basically the only reason left that you'd ask a contractor to sign a non-compete is that you don't want him/her to do legal, non-infringing, and otherwise ethical work with a client who happens to be a competitor. And that defeats the purpose of being a contractor in the first place, especially for those gaining expertise in a field.
That's the reason why non-competes aren't even allowed in certain countries and American states. _________________ /////////////////////////

Actually I don't think anyone will sign a non-compete on a contract thats not longterm and correspondingly compensated (which means an inhouse / inteam developer, not a temporary contractor), as they would be signing their own bancrupty as they are locked out of their work field which is, mentioned above, do work for others independing of the field (and commonly in similar field as you are more experienced and can offer more) _________________ Technologies: Unity Pro, iPhone Advanced

| I just used it for infringement purposes that's pretty much why I would like them to sign, and some people leave you without saying anything. I need to be protected you know. |

Fully understand that you want to protect yourself.
But non-compete is a pretty drastic way and the payment would in no way relate to a non-compete if it is a general non-compete.
if it is a "non-compete until the project is done + a few weeks", then its naturally something else. Thats something I personally wouldn't have a problem signing as it basically binds me to the project and will only hurt those who decide to betray you / leave with no reason. _________________ Technologies: Unity Pro, iPhone Advanced

I don't think a non-compete is legally enforcable anyway, especially in this case where it's a lone contractor doing a small job, as you're depriving the contractor of future trade.
Obviously it's good manners (or just sound business sense) not to work on a similar game at the same time as you're working on this one.
Anyway, I wouldn't worry about the contractor ripping you off, if the game is successful there's going to be lots of companies releasing very similar games who aren't bound by non-compete, trademark or patent law.... |

Yeah, I understand and that makes sense. I'm not trying to suggest you're out to get people. I'm just saying that infringing is already covered by copyright law and the NDA is all.
Depending on the details, what you have in the non-compete could be reasonable and fine. Certainly it's a good idea to try to prevent developers from working on a similar thing during the term of the contract. I don't blame you there.
I'd be interested myself, but I don't have iPhone experience. I hope you find someone, though. _________________ /////////////////////////
